When is a Transfer of Permit Required 

Transferring an environmental permit is a crucial step when ownership or operational control of a site changes. This ensures that the new permit holder is aware of and can comply with the permit conditions, thereby maintaining environmental protection and regulatory compliance. The most common reasons why a transfer of permit is required is when an existing operator sells their waste business to someone else, or where the operator no longer has significant control over the operation, for example, if they allow another operator to operate out of that facility because they have let the business out. 

What does a Transfer of Permit Involve?

If you are transferring an installations or waste operations permit then then the following application forms will need to be completed:

The person who wants to take over the permit must fill in:

Part A: about you

Part D2: application for transfer (installations, waste operations and mining waste operations)

The person who wants to take over the permit must be the legal operator and meet the competence requirements.

The current permit holder and the person who wants to take over the permit must complete the relevant declarations within the application form:

Part F1: charges and declarations

Evidence of Technical Competency

Management Systems as specified by the type of permit being transferred

The Environment Agency do not allow a grace period for technical competency when transferring a permit. The new operator will need to demonstrate that they have a qualified person under the CIWM WAMITAB Scheme. Evidence of continuing competency will also be required where the TCM has held their primary qualification for over 2 years.

The management systems that will need to be submitted as part of the transfer need to demonstrate the new operator can comply with the rules of the permit and prevent pollution to the environment from the waste activity. 

Once the application has been submitted, the Environment Agency will assess the application and suitability of the new operator. Once the conditions have been met, the transfer of permit will be issued.
